About the Permission of Fine-tune Models

Hi, I've made a Blue Archive art style Fine-tune based on this model, and I have released it on CivitAI (https://civitai.com/models/212253), but I have a problem about the permissions.
You see, my dataset is 100% from Blue Archive's official artwork, and according to Blue Archive's Fanart Guideline, this model should not be used on any kinds of commercial use.
But Animagine XL v3's commercial license is only 'not selling the model or merges', it doesn't limit selling the generated image or using generation service. Also, it asked for merge model to release at same permissions.
This seems to be a conflict from my view.
I wonder if fine-tune model should be consider as a 'merge' model, or may I use a different, but stricter permission (still no credit need)?

Alternatively, stick with the FAIPL license but add a disclaimer clearly stating the Blue Archive Fanart guidelines to prevent the commercial use of images generated using your model.

I just saw the blue archive model today, and I was VERY impressed by it.
I am very happy there's such an open communication on the downstream uses of AI, and clearly i'm glad there's more details on how these things work :)

Does 'none' for commercial use in CivitAI's release page count as similar but same distribution goals?

This model is just a test to see if I can get proper effort from SDXL models, very happy to see it does work out!
Animagine XL V3 is a great model, can't wait to see a full version which covered those early day's characters (KC Haruna lover here),
I'm still working on this one, going to make a proper dataset & manually edit captions to see whether can make it any better.

My suggestion is to make the permits identical to the Animagine XL 3.0 model, but with a slight modification: do not activate the 'Sell generated images' feature as it conflicts with the Blue Archive fanart guidelines.

I see, but the 'Commercial Use' selection is listed from least to most permissive, I can pick only one of it.
If I choose 'use on Civitai generation service', it will force the permission of 'sell generated images', so latter way I guess? keeping same permits but with disclaimer?

You can pick the "None" option since it won't allow any kinds of commercialization. Hope this helps~ ^^
