(KSWO) - In a fight for transparency, KSWO is suing the Comanche County Detention Center for allegedly violating the open records act. On January 30, KSWO filed an open records request for the surveillance video surrounding Keith Bradley's death inside the Comanche County Detention Center. Bradley was the sixth inmate to die in the facility in 2023. The detention center denied our open records request citing a potential security risk, and saying it is considered a Law Enforcement Agency and operates as a public trust so it is not required to release the footage. In efforts to find answers for families of the deceased and taxpaying citizens who fund CCDC, KSWO moved forward with litigation. In June, CCDC attorneys filed a motion to dismiss our lawsuit. That hearing was held Thursday, Aug. 29, and after hearing arguments from both sides, Judge Emmit Tayloe denied the motion of dismissal. "Oh, I think it's a huge public interest. People need to understand, the general public needs to understand how their jails are run, what happens in their jails," said Justin Hiersche, part of KSWO's council. "They're not open to the public. Generally, you don't get to see in through windows. So, because of that you need access to these types of videos. The public can make determinations to how it should be run different, or can it be run different." The defense argued that KSWO has still been able to report on CCDC incidents, just without video, and reiterated the release of the video provides a security risk to how the jail operates. However, attorneys for KSWO said any security risks revealed by the tape such as blind spots would only encourage staff to get rid of those issues. Our attorney's presented a lawsuit between Frontier Media Group and the Pottawatomie County Jail over the same issue. Frontier was requesting surveillance footage from inside the jail and questioning whether it was a "law enforcement agency." Frontier won the case, which ordered the county jail to release the video. 7News' attorney's said even if CCDC is considered a law enforcement agency, the public interest itself is enough to warrant the release of the footage. While this is a step in the right direction, it's not over yet. An evidentiary hearing will be held on October 25.....
