which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to list fentanyl-related substances as schedule I controlled substances.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Overdoses of Fentanyl Analogues Act</short-title></quote>.</text></section><section id="id60EB3C941B7F4B5E867C9A09C1E6E648"><enum>2.</enum><header>Fentanyl-related substances</header><subsection id="id5C5A542D1CA044C2965E114C42D6E5E5"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended—</text><paragraph id="id9853CBCA1BDD4C099C4713A24A688C87"><enum>(1)</enum><text display-inline="yes-display-inline">by adding at the end of subsection (b) of Schedule I the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFDE1B015287F482BAA896DE9DF86294B"><paragraph id="id182781199da3434abc14a69167bb66e5"><enum>(23)</enum><text>Isobutyryl fentanyl.</text></paragraph><paragraph id="id57d8184853c04bd5aec9671e336925de"><enum>(24)</enum><text>Para-Methoxybutyrylfentanyl.</text></paragraph><paragraph id="id3ed273f4b97e428296d77a4d3119543a"><enum>(25)</enum><text>Valeryl fentanyl.</text></paragraph><paragraph id="idf3a4dbca63484e45a3b807969f8e9cdb"><enum>(26)</enum><text>Cyclopentyl fentanyl.</text></paragraph><paragraph id="id5a691ef9911749c7806109891c5db724"><enum>(27)</enum><text>Para-Chloroisobutyryl fentanyl.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idB934BB756A764CF0A3044CE90AFA4374"><enum>(2)</enum><text>by adding at the end of Schedule I the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5C7570C690944EFEB8BB19D7D7E940D1"><subsection id="idFFDF3CACBBE84DFFBBB81DBD77301C52"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id9AC7428E07114D6DA7BFA95A054141FF"><enum>(1)</enum><text>Unless specifically exempted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of fentanyl-related substances, or which contains their salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation.</text></paragraph><paragraph id="id5FFCBB4C924C45C7A5C6EFF7AB492621" indent="up1"><enum>(2)</enum><text>In paragraph (1), the term <quote>fentanyl-related substances</quote> includes the following:</text><subparagraph id="idCAF95DB9DA7F4729B97F5776C814D990"><enum>(A)</enum><text>Any substance that is structurally related to fentanyl by one or more of the following modifications:</text><clause id="id10A1313AFEDB47269191E25843BBAE95"><enum>(i)</enum><text>By replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted in or on the monocycle.</text></clause><clause id="idB9BF3F86ECAF443CAE8C8BEB6FF35F0F"><enum>(ii)</enum><text>By substitution in or on the phenethyl group with alkyl, alkenyl, alkoxy, hydroxy, halo, haloalkyl, amino or nitro groups.</text></clause><clause id="id02A31EA3EE9B42D2B6245B1B214EC995"><enum>(iii)</enum><text>By substitution in or on the piperidine ring with alkyl, alkenyl, alkoxy, ester, ether, hydroxy, halo, haloalkyl, amino or nitro groups.</text></clause><clause id="id3D76FCFB91884049BB88DE36FE101062"><enum>(iv)</enum><text>By replacement of the aniline ring with any aromatic monocycle whether or not further substituted in or on the aromatic monocycle.</text></clause><clause id="id739CFD6370EF4F65A78C4E274237FDED"><enum>(v)</enum><text>By replacement of the N-propionyl group by another acyl group.</text></clause></subparagraph><subparagraph id="idd71bcbaf85eb4f7c9f6eb3ef97491f53"><enum>(B)</enum><text>4′-Methyl acetyl fentanyl.</text></subparagraph><subparagraph id="idded5ba09b8ac4b84be93f60d475ec639"><enum>(C)</enum><text>Crotonyl fentanyl.</text></subparagraph><subparagraph id="idb5d4a62dbbc0441ab635c6c55c05cda4"><enum>(D)</enum><text>2′-Fluoro ortho-fluorofentanyl.</text></subparagraph><subparagraph id="idec387b9f00754662898c4264772d5ef2"><enum>(E)</enum><text>Ortho-Methyl acetylfentanyl.</text></subparagraph><subparagraph id="idf2d737b0d7474a21a9fc4d7d739ba253"><enum>(F)</enum><text>Thiofuranyl fentanyl.</text></subparagraph><subparagraph id="idac623340ff654ce1b42b65e9e06707f9"><enum>(G)</enum><text>Ortho-Fluorobutyryl fentanyl.</text></subparagraph><subparagraph id="ida1b2718a9c764cb5bf3af6ad2e328f66"><enum>(H)</enum><text>Ortho-Fluoroacryl fentanyl.</text></subparagraph><subparagraph id="id16b01a3606ef41cdb83acae399e1f94f"><enum>(I)</enum><text>Beta-Methyl fentanyl.</text></subparagraph><subparagraph id="id1e9691daeb374943a8d693ed9f8fe0eb"><enum>(J)</enum><text>Phenyl fentanyl.</text></subparagraph><subparagraph id="id5009d7a4e7474ed19b1383ea9e8e0096"><enum>(K)</enum><text>Para-Methylfentanyl.</text></subparagraph><subparagraph id="idb625b4454bd54c8a89eb4d6c5bfe6d5e"><enum>(L)</enum><text>Beta′-Phenyl fentanyl.</text></subparagraph><subparagraph id="iddc534dcf1d2c4028b443fda1e5eefa29"><enum>(M)</enum><text>Benzodioxole fentanyl.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5AD41FCAC6634C26BF9DF85A359F5AED"><enum>(b)</enum><header>Effective date</header><text>This Act shall take effect 1 day after the date of enactment of this Act. </text></subsection></section></legis-body></bill> |
